General terms of service

SF Auto Labs is your destination for automotive repair and advisory services in the San Jose and SF Bay Area. The following Services Terms and Conditions apply:

  • Service Rights: SF Auto Labs reserves the right to refuse service to any individual at its sole discretion.
  • Booking Policy: While we strive to maintain our booking schedule as acurate as possible reservations and bookings do not guarantee a specific time slot, bay, or workstation. All planned work on your vehicle must be discussed and agreed upon with an SF Auto Labs mechanic before commencement.
  • Refund Policy: If SF Auto Labs is unable to provide the agreed service at the designated time, all fees and deposits will be refunded in full. Please allow 2-4 weeks for refunds for payments made by check or cash. Should you cancel your reservation 7 or more business days prior to the first day of the scheduled service, you will receive a 100% refund. Deposit refunds are not available for cancellations made less than 7 business days before the service start time.
  • Appointment Policy: SF Auto Labs reserves the right to alter appointment times, dates, and bays without prior notice. Deposits paid will be applied to the final invoice at SF Auto Labs for the scheduled appointment. Your appointment duration is from the scheduled start to end time, with full service day running from 11AM to 7PM, and half service day from 11AM to 3PM and 4PM to 8PM.
  • Cancellation Policy: Deposits are forfeit if appointments are cancelled or unattended. Rescheduling is permitted given 24 hours prior notice.
  • Warranties and Guarantees: SF Auto Labs does not provide any warranties, either express or implied, and offers no guarantees for any services booked.
  • Eligibility: You must be 18 years or older to book an appointment. 
  • Vehicle Ownership: Proof of ownership may be required for the vehicle being serviced.
  • Billing Policy: For longer term projects extending beyond one week, interim payments towards the final invoice may be required at the end of each week.
  • There is a zero tolerance policy for alcohol or marijuana use while using the shop. Contained food and non-alcoholic beverages are allowed. If you are drinking alcohol anywhere on the premises you will be asked to pack up and leave, it may also result in service cancelation, no refund will be available in this case.
  • Compliance: Failure to comply with these terms will result in forfeiture of your deposit and appointment.
  • Changes to Terms: SF Auto Labs reserves the right to modify these terms at any time without notice.

ECU Tuning terms

1. ACCEPTANCE OF TERMS

You must be at least 18 years old and capable of forming a binding contract to accept these Terms.

By clicking “I Agree,” submitting an order, or otherwise using our website or Services, you acknowledge that you have read, understood, and agree to these Terms and any additional guidelines or rules posted on our site.

 

2.  SCOPE OF SERVICES

  • Services Offered. SF Auto Labs, in partnership with DAS Project A, provides vehicle performance tuning, ECU calibration, installation, testing, and related support services (“Services”). 

  • Products may include downloadable calibration files, tuning modules, or hardware components necessary to adjust engine performance.

  • Off-Road/Track Use Only. All Services and Products are expressly recommended for off-road, track, or closed-course applications. Use on public roads or emission-controlled vehicles is at your own risk. You are responsible for compliance with all local, state, and federal laws, including emissions regulations.
  • Location and Availability. Our Services are available only in Northern California. We reserve the right to limit or refuse service to any Customer for any reason.

 

3. REGISTRATION AND AUTHORIZATION

  • Account Registration (if applicable). To purchase certain Products or schedule Services, you may be required to create an account and provide current, complete, and accurate information. You are responsible for maintaining the confidentiality of your account credentials.
  • Authorization to Work on Your Vehicle. Prior to any installation or tuning service, you must provide proof of ownership or lawful authorization to modify the vehicle in question. We may refuse service if you cannot demonstrate ownership or authorization.

 

 

4. DISCLAIMER OF PERFORMANCE AND USAGE

  • Assumption of Risk. High-performance tuning inherently carries risks (e.g., increased engine stress, altered drivability, reduced component lifespan). By using our Services, you assume all such risks.
  • No Manufacturer Warranty. Tuning may void or impact your vehicle’s original manufacturer warranty. We make no representations regarding whether tuning will void any OEM warranty. You should confirm with your manufacturer or dealership before proceeding.
  • Return to Stock. If diagnostic testing, emissions inspections, or dealer service is necessary, you must revert your vehicle to factory settings. We offer “return-to-stock” Services at additional cost; contact us for details.

 

5. PERFORMANCE AND SERVICE DISCLAIMER

  • No Guarantees of Specific Results. Results (such as horsepower, torque, or fuel efficiency) vary by vehicle make, model, condition, and usage. We do not guarantee any specific performance gains.
  • Vehicle Wear and Tear. By providing your vehicle for Services, you consent to SF Auto Labs or DAS Project A representatives operating the vehicle for testing or validation. We are not responsible for normal wear and tear, mechanical breakdowns, or incidental damage incurred during testing.
  • Additional Expenses. If fuel, fluids, or other consumables are required during testing, you will be invoiced for those costs. Payment is due upon receipt of invoice.

 

6. LIMITATION OF LIABILITY

  • No Liability for Damages. To the fullest extent permitted by law, SF Auto Labs, DAS Project A, and their affiliates, officers, employees, and agents disclaim any liability for direct, indirect, incidental, consequential, punitive, or special damages arising from your use of our website, Products, or Services.

 

  • Maximum Liability. Our maximum liability for any claim arising under or related to these Terms shall not exceed the total fees you paid for the specific Service or Product at issue.
  • Improper Installation or Misuse. We assume no liability for damage resulting from improper installation, misuse, neglect, or unauthorized modifications performed by you or third parties.

 

7. WARRANTY DISCLAIMER

  • “As-Is” Provision. All Products and Services are provided “as-is,” without any warranty of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • No Refunds or Returns. All sales of Products and Services are final. There are no refunds, returns, or exchanges, even for shipping, handling, or processing fees. You are responsible for insuring any Vehicle or parts shipped to us.

 

8. INDEMNIFICATION

  • You agree to indemnify, defend, and hold harmless SF Auto Labs, DAS Project A, and their respective officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or relating to:
    • Your use of the Services or Products;
    • Your violation of these Terms;
    • Your violation of any third-party right (including intellectual property, privacy, or publicity rights);
    • Any claim that your use of our Services or Products caused damage to a third party.

 

9. INTELLECTUAL PROPERTY

  • Ownership. All content on our website (including text, graphics, logos, images, audio, video, and software) is the property of SF Auto Labs or its licensors and is protected by U.S. and international copyright laws.
  • Limited License. You are granted a limited, non-exclusive, non-transferable license to access and use our website and Services for personal or commercial use, subject to these Terms.
  • Restrictions. You may not copy, reproduce, distribute, modify, publicly display, or create derivative works of any portion of our website or Products without express written permission.

 

10. PRIVACY AND DATA COLLECTION

  • Your privacy is important. Our Privacy Policy (available at www.sfautolabs.com/privacy) describes how we collect, use, and share information about you. By using our website or Services, you consent to the collection and use of your information as described in the Privacy Policy.

 

11. CHANGES TO TERMS

  • Modifications. We may update these Terms at any time. The revised Terms will be posted on our website with an updated “Effective Date.”
  • Your Responsibility. It is your responsibility to review these Terms periodically. Your continued use of the website or Services after any changes constitutes acceptance of the new Terms.

 

12. GOVERNING LAW AND DISPUTE RESOLUTION

  • Governing Law. These Terms and any dispute arising under them shall be governed by the laws of the State of California, without regard to its conflict-of-law principles.
  • Jurisdiction. Any legal action or proceeding related to these Terms must be brought exclusively in the state or federal courts located in Santa Clara County, California. You consent to personal jurisdiction and venue in those courts.

 

13. SEVERABILITY

  • If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, that provision shall be struck, and the remaining provisions will remain in full force and effect.

By using our website or Services, you acknowledge that you have read, understood, and agree to these Terms of Service in full. If you do not agree to these Terms, do not use our website or purchase any Services.
